- “Services” refers to seamless gutter installations, repairs, cleaning, backup water systems, rainwater harvesting systems, roof painting, waterproofing, and solar panel cleaning provided by FR Gutters.
- “Property” refers to the residential or commercial location where services are to be performed.
2. Services Provided
FR Gutters provides the following services:
- Seamless gutter installations, repairs, and cleaning
- Backup water and rainwater harvesting systems
- Roof painting and waterproofing
- Solar panel cleaning
The specific scope of work for each project will be detailed in a separate service agreement or quote provided to the client.
3. Quotes and Pricing
- All quotes provided are valid for 30 days from the date of issue.
- Quotes are based on the information provided by the client and visual inspection of the property.
- Additional costs may apply if unforeseen circumstances arise during the project.
- A 50% deposit is required before commencement of work, with the remaining balance due upon completion.
- Prices are subject to change without notice for new quotes.
4. Payment Terms
- Accepted payment methods include bank transfer, cash, and credit card.
- Late payments will incur a fee of 2% per month on the outstanding balance.
- FR Gutters reserves the right to place a lien on the property until payment for services rendered is received.
- All prices quoted are inclusive of VAT unless otherwise stated.
5. Project Schedule
- Project start and completion dates will be agreed upon before work commences.
- FR Gutters will make reasonable efforts to complete work within the agreed timeframe.
- Delays due to weather conditions, material availability, or other factors beyond our control may affect the completion date.
- The client will be notified of any significant delays as soon as possible.
6. Client Responsibilities
- Provide accurate information about the property and required services.
- Ensure access to the property on scheduled service dates.
- Remove valuable or fragile items from work areas.
- Inform FR Gutters of any property-specific conditions that may affect service delivery.
- Secure necessary permissions from relevant authorities or homeowners’ associations if required.
7. Warranties and Guarantees
7.1 Gutter Clearance Guarantee
FR Gutters provides a 3-month guarantee on gutter clearance work. If you notice any blockages in sections of guttering that we have cleared within this period, we will return to clear the blockage free of charge6.
7.2 Gutter Repairs and Installation Guarantee
We provide a 6-month parts and workmanship guarantee on gutter repairs and installations. If the repair or installation proves ineffective within this period, we will return to correct any faults free of charge6.
7.3 Limitations
Our guarantees extend to cover normal weather conditions only and do not cover damage caused by:
- Extreme weather events, including violent storms or torrential rainstorms
- Wind damage
- Vandalism
- Modifications carried out by other contractors
- Any other circumstances beyond our control6
To make a claim under these guarantees, clients must provide proof of our previous work.
8. Cancellation Policy
- Cancellations made more than 48 hours before scheduled service will not incur a fee.
- Cancellations made less than 48 hours before scheduled service may incur a fee of 25% of the quoted price.
- No-shows or cancellations on the day of service may incur a fee of 50% of the quoted price.
9. Liability and Indemnification
- FR Gutters carries appropriate insurance coverage for our services.
- We are responsible for damages directly caused by our negligence during service provision.
- FR Gutters is not liable for pre-existing property conditions or damages not directly related to our services.
- The client agrees to indemnify and hold FR Gutters harmless against any claims of loss or damage, except in cases of willful misconduct or gross negligence5.
10. Intellectual Property
- All content on the FR Gutters website, including text, graphics, logos, and images, is the property of FR Gutters and is protected by copyright laws.
- Unauthorized use, reproduction, or distribution of any content from our website is prohibited without written permission.
11. Privacy Policy
- FR Gutters collects client information solely for the purpose of providing and improving our services.
- We do not sell or share client information with third parties except as required to fulfill our services.
- Client information is stored securely and in accordance with applicable data protection laws.
12. Force Majeure
FR Gutters shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to:
- Natural disasters
- Severe weather conditions
- Government actions
- Labor disputes
- Supply shortages
- Public health emergencies
13. Dispute Resolution
- Any disputes arising from these terms and conditions shall first be addressed through informal negotiation.
- If a resolution cannot be reached, the dispute shall be submitted to mediation before pursuing legal action.
- These terms and conditions are governed by the laws of South Africa.
14. Amendments to Terms
- FR Gutters reserves the right to modify these terms and conditions at any time.
- Changes will be effective immediately upon posting to our website.
- Continued use of our services after changes constitutes acceptance of the modified terms.
15. Severability
